End User License Agreement (EULA)

This End User License Agreement (the „Agreement“) is a legal agreement between you (the „User“ or „You“) and Computerfamilie („Company,“ „we,“ „us,“ or „our“) regarding your use of the „The Brain Train“ mobile application (the „App“) on Android and iOS devices.

By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement. If you do not agree to the terms, do not download, install, or use the App.

1. License Grant

Subject to your compliance with the terms of this Agreement, the Company grants you a non-exclusive, non-transferable, revocable license to download, install, and use the App for personal, non-commercial purposes on your mobile device.

2. Restrictions

You agree not to:

• Modify, adapt, translate, or create derivative works based on the App.
• Distribute, sell, lease, or sublicense the App.
• Reverse engineer, decompile, or disassemble the App.
• Use the App in any manner that could damage, disable, overburden, or impair the App or interfere with any other party’s use of the App.

3. Ownership

The App is licensed, not sold, to you. The Company retains all rights, title, and interest in and to the App, including all intellectual property rights. Your rights to use the App are limited to those expressly granted in this Agreement.

4. User Data and Privacy

Your use of the App may involve the collection and use of personal information. Please refer to our Privacy Policy [insert link to Privacy Policy] for information on how we collect, use, and protect your information.

5. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically if you fail to comply with any of the terms. Upon termination, you must cease all use of the App and delete it from your devices.

6. Disclaimer of Warranty

The App is provided „as is“ and „as available,“ without warranty of any kind. The Company does not warrant that the App will be error-free, uninterrupted, or free of harmful components. Your use of the App is at your own risk.

7. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, even if the Company has been advised of the possibility of such damages.

8. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys‘ fees) arising out of your use of the App or your violation of this Agreement.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Germany. Any disputes arising from this Agreement shall be resolved in the courts of Germany.

10. Changes to the Agreement

The Company reserves the right to modify this Agreement at any time. We will notify you of any changes by posting the new Agreement on our website or through the App. Your continued use of the App after any changes indicates your acceptance of the new terms.
